Nevada Court Extends Injunction, Kalshi Prediction Market Faces Regulatory Challenges


On April 4, a Nevada state court ruled that the sports contracts offered by Kalshi are “substantially indistinguishable” from sports betting (“sports betting”), and decided to extend the temporary injunction against its related businesses. The court held that buying sports event contracts is essentially equivalent to placing bets on a sports betting platform, and therefore constitutes unlicensed gambling activity. This ruling marks that multiple states in the United States are tightening regulation of prediction market platforms, especially for sports-related products. Kalshi argues that it is a derivatives market regulated by the CFTC and should not be subject to state-level sports betting regulations. At the same time, the CFTC and the Department of Justice have jointly sued multiple states in an effort to secure federal regulatory authority. The current regulatory dispute is still ongoing, and future impacts on the prediction market industry are expected to be far-reaching.
