According to Xinhua News Agency, FedEx filed a lawsuit on February 23rd with the U.S. International Trade Court in New York City, demanding a full refund from U.S. Customs and Border Protection and the U.S. government for import tariffs levied under the U.S. International Emergency Economic Powers Act.
The complaint states that on the 20th, the U.S. Supreme Court overturned tariffs imposed by an executive order signed by the President under the International Emergency Economic Powers Act. The International Trade Court has the authority to decide on the refund of relevant taxes paid by importers. Therefore, the plaintiff seeks a full refund of the tariffs paid by the defendant.
The complaint did not disclose the total amount of tariffs paid by FedEx.
In September 2025, FedEx executives stated that U.S. tariff policies are expected to impact the company’s revenue by $1 billion in the 2026 fiscal year.
Court records show that over 1,000 companies in the U.S. have joined legal actions demanding the government refund the tariffs paid. Major companies involved include Costco, Reebok, and others.
On the 20th, the U.S. Supreme Court announced its ruling, determining that the U.S. International Emergency Economic Powers Act does not authorize the President to impose large-scale tariffs. According to a budget model from the Wharton School at the University of Pennsylvania, the Supreme Court’s final ruling on tariffs involves a refund amount of $175 billion.
